Is news aggregation legal?

When discussions about aggregation and fair use occur, I often hear people misstate the legal concepts that surround these issues.

Kimberley Isbell of Citizen Law Project offers a clear, straightforward guide to the legal implications around aggregating news and fair use.

She notes that one of the problems is a relative lack of case law around the issue (most cases reach negotiated settlements before the courts have a chance to rule).
